This Terms of Sale and Refund Policy applies to the Adopt-a-Kelp program offered by West Coast Kelp (“WCK”, “we”, “us”, or “our”). By purchasing or participating in an Adopt-a-Kelp adoption through our website, you agree to the terms outlined below.
1. Nature of the Adopt-a-Kelp Program
The Adopt-a-Kelp program is a restoration support initiative offered by West Coast Kelp. When you adopt kelp, you are supporting kelp cultivation, deployment, monitoring, and associated field, operational, and research activities carried out by West Coast Kelp.
An adoption:
Represents support for kelp restoration and related work
Is not a charitable donation
Does not confer ownership of any physical kelp, marine area, or ecosystem
Does not guarantee survival, growth rate, location permanence, or ecological outcomes
Kelp restoration is influenced by natural variability, including but not limited to ocean conditions, weather, seasonal cycles, permitting requirements, and environmental factors beyond our control.
2. Purchase Terms
All Adopt-a-Kelp purchases are processed through our website using secure third-party payment providers.
By completing a purchase, you acknowledge and agree that:
Your adoption supports ongoing and future restoration activities
Program timelines may shift due to environmental or operational conditions
Updates are provided as part of a long-term process rather than a fixed deliverable schedule
Prices are listed in the applicable currency at checkout and are subject to change without notice.
3. Program Updates and Communications
As part of the adoption experience, adopters may receive periodic updates documenting stages such as cultivation, deployment, monitoring, and observation. These updates are intended to share learning and progress rather than certify outcomes.
The frequency, format, and content of updates may evolve over time as the program develops.
4. No Refund Policy
All Adopt-a-Kelp adoptions are final and non-refundable.
This includes, but is not limited to:
Changes in personal circumstances
Delays or alterations to program timelines
Environmental impacts affecting kelp survival or monitoring
Modifications to deployment locations or methods
Once an adoption is purchased, funds are committed to restoration-related activities and cannot be returned.
5. Cancellations and Program Changes
West Coast Kelp reserves the right to modify, pause, or discontinue aspects of the Adopt-a-Kelp program if required due to environmental conditions, regulatory requirements, safety considerations, or operational constraints.
In such cases, no refunds will be issued, but we may communicate adjustments or alternative approaches where appropriate.
6. Force Majeure and Environmental Uncertainty
Kelp restoration work occurs in real ocean environments and may be affected by events beyond our reasonable control, including but not limited to:
Extreme weather or ocean conditions
Equipment failure
Regulatory or permitting changes
Ecological disturbances
West Coast Kelp is not liable for outcomes resulting from such events.
7. Limitation of Liability
To the fullest extent permitted by applicable law, West Coast Kelp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to participation in the Adopt-a-Kelp program, including but not limited to loss of data, loss of revenue, or perceived loss of anticipated outcomes.
Participation in the Adopt-a-Kelp program is voluntary and undertaken with an understanding of the inherent uncertainty, variability, and risk associated with ecological restoration work conducted in open marine environments.
8. Governing Law and Jurisdiction
This policy and any related transactions are governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada.
West Coast Kelp operates from Canada; however, the Adopt-a-Kelp program may be purchased by customers located internationally.
